These Terms & Conditions ("Terms") govern your access to and use
of the Curb platform at curb-sales.com (the "Service") operated by
Curb ("we," "us," or "our"). By creating an account, using the
Service, or receiving communications through the Service, you agree
to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and have the authority to enter
into these Terms on behalf of yourself or the business entity you
represent. By using the Service, you represent and warrant that you
meet these requirements.
2. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the security of your account and for all activity that occurs under it.
- You must notify us immediately if you suspect unauthorized access to your account.
3. Description of the Service
Curb is an AI-powered operations platform for small service
businesses. We automate the communication and administrative tasks
that keep businesses running, so owners can focus on the work
itself. The Service includes:
- AI-powered call answering and routing -incoming calls are answered, classified by intent, and routed to the appropriate person or workflow.
- SMS text messaging -automated appointment reminders, estimate follow-ups, job status updates, payment reminders, and review requests sent on behalf of the business.
- Lead capture and follow-up -inbound leads from calls, texts, and web forms are captured and automatically followed up with.
- Workflow automation -configurable workflows that trigger actions based on business events (new lead, completed job, missed call, etc.).
- Daily briefs and reporting -automated summaries of business activity delivered to the owner.
- Integration with existing business tools and CRMs.
4. SMS and Text Messaging Terms
This section applies to all SMS text messages sent and received
through the Curb platform.
4.1 For Business Customers
- You are responsible for obtaining proper consent from your customers before using Curb to send them SMS messages.
- You must only message customers who have provided their phone number directly to your business and have consented to receive communications from you.
- You must not use the Service to send unsolicited messages, spam, or messages to purchased contact lists.
- You are responsible for complying with all applicable laws and regulations regarding SMS messaging, including the Telephone Consumer Protection Act (TCPA) and applicable state laws.
- All messages sent through Curb will include opt-out instructions (reply STOP to unsubscribe).
4.2 For Consumers Receiving Messages
- Messages are sent through the Curb platform as part of your interaction with a business using our service. These messages are related to your service request and include appointment reminders, job updates, follow-ups, billing notifications, and review requests.
- Opt-out: You can stop receiving SMS messages at any time by replying STOP to any message. You will receive a single confirmation and no further messages unless you re-initiate contact.
- Help: Reply HELP to any message for assistance, or contact us at admin@curb-sales.com.
- Message frequency: Message frequency varies based on your interaction with the business. You may receive messages related to appointments, job updates, payment reminders, and review requests.
- Message and data rates may apply. Consult your wireless carrier for details about your messaging plan.
- Consent to receive messages is not required as a condition of purchasing any goods or services from the business.
- Carriers are not liable for delayed or undelivered messages.
- By providing your phone number to a business using Curb, you agree to receive SMS messages related to your interaction with that business.
5. Voice Call Terms
- Curb provides AI-powered call answering on behalf of businesses that subscribe to our Service.
- Inbound calls to a business using Curb may be answered by an AI assistant that will classify the caller's intent, collect relevant information, and route the call or trigger appropriate follow-up actions.
- Call metadata (phone number, timestamp, duration, and intent classification) is logged and available to the business.
6. Subscriptions & Billing
- The Service is offered on a subscription basis. Current pricing is provided during onboarding.
- Subscriptions renew automatically on a monthly basis. You may cancel at any time.
- Payments are processed securely by a third-party payment processor. We do not store your credit card details.
- We reserve the right to change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing.
- Refunds are handled on a case-by-case basis. Contact us if you believe a charge was made in error.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Send unsolicited messages, spam, or communications to individuals who have not consented to receive them.
- Use the Service to harass, threaten, or intimidate any person.
- Misrepresent the identity of the sender of any communication sent through the Service.
- Scrape, data-mine, or systematically extract data from the Service beyond normal use.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Share, resell, or sublicense your account or access to the Service to third parties without our written consent.
- Upload malicious code, viruses, or any content that could harm the Service or other users.
- Send messages that contain illegal content, promote illegal activity, or violate any applicable law or regulation.
8. Intellectual Property
- The Service, including its design, code, algorithms, and branding, is owned by Curb and protected by intellectual property laws.
- You retain ownership of content you create (message templates, customer lists, business configurations) and grant us a limited license to store, process, and transmit that content to provide the Service.
9. Privacy
Your use of the Service is also governed by our
Privacy Policy, which describes how we
collect, use, and protect your information. By using the Service,
you consent to the collection and use of information as described
in our Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available" without
warranties of any kind, either express or implied, including but not
limited to implied warranties of merchantability, fitness for a
particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or secure.
- We do not warrant the accuracy of AI-generated classifications, responses, or summaries.
- We are not responsible for decisions you make based on information provided by the Service.
- We do not guarantee delivery of any SMS message or voice call. Delivery depends on carrier networks and other factors outside our control.
11. Limitation of Liability
To the maximum extent permitted by law, Curb and its officers,
directors, employees, and agents shall not be liable for any
indirect, incidental, special, consequential, or punitive damages,
or any loss of profits or revenue, whether incurred directly or
indirectly, arising from:
- Your use of or inability to use the Service.
- Any inaccuracy in AI-generated content or classifications.
- Unauthorized access to your account or data.
- Failure or delay in message delivery.
- Any third-party conduct or content on the Service.
Our total aggregate liability for all claims arising from or related
to the Service shall not exceed the amount you paid us in the twelve
(12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Curb and its affiliates
from any claims, damages, losses, or expenses (including reasonable
attorney fees) arising from your use of the Service, your violation
of these Terms, your messaging practices, or your infringement of
any third-party rights.
13. Termination
- You may cancel your subscription and close your account at any time.
- We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users.
- Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Kansas, without
regard to conflict-of-law principles. Any disputes arising from
these Terms or the Service shall be resolved in the state or federal
courts located in Sedgwick County, Kansas.
15. Changes to These Terms
We may modify these Terms at any time. We will notify you of
material changes by posting the updated Terms on our website and
updating the "Last Updated" date above. Continued use of the
Service after changes constitutes acceptance of the revised Terms.
